A Last Will and Testament is a document that designates the person who will manage your estate upon your death. This person is often referred to as the executor or personal representative. The Will also designates who will receive the estate upon death. A Will can be drafted by the individual, by using an internet service or software program or it can be professionally prepared by an estate planning attorney.

Many individuals are under the misimpression that a Will avoids probate. In fact, the administration of a Will requires a proceeding in the Riverside County Superior Court or the San Bernardino County Superior Court. The location of the probate is based on where the decedent lived at the time of death.

For those individuals who desire to avoid the time, expense and publicity of a probate administration, a revocable living trust is most often the answer.

A living trust is a legal document most often prepared by an estate planning attorney. During life, title to the assets of the individual are transferred to the trust. Usually, the individual remains the trustee or person in charge of his or her assets during lifetime. Upon death or disability, a successor trustee can take over management of the person’s finances. Because the living trust does not die upon the death of the individual, there is no need for a probate proceeding in the Riverside or San Bernardino courts.
