Planning for Long Term Care


Many seniors and their family members are worried about the cost of long term care. They wonder how they will pay for in home caregivers. They are fearful that the cost of a long term stay in an assisted living facility or a Riverside skilled nursing facility will deplete their income and savings. Riverside elder law attorney Dennis M. Medicare

Nursing Home and Rehabilitation Hospitals

Many seniors mistakenly believe that Medicare pays for care at home or in an assisted living facility or nursing home. In fact, Medicare pays for only limited long term care services. Under certain limited circumstances, Medicare pays for nursing home or rehabilitation hospital services in Riverside County or San Bernardino County. However, payment for these circumstances is limited to twenty days, with an additional eighty days of coverage after the senior pays a daily share of cost of $148 per day (for 2013). After one hundred days, Medicare pays nothing toward the cost of skilled nursing home care. The Medicare website contains more information about what services are paid for by Medicare.

Hospice

Medicare pays for hospice services in the senior’s home or in an assisted living facility or skilled nursing home.

In-Home, Assisted Living and RCFE (Residential Care for the Elderly) Facilities

Medicare does not pay for caregiving services in the home (except for hospice services) or for care in a Riverside assisted living or RCFE facility (RCFE facilities are also known board and care homes).

Private Pay

Long Term Care Medi-Cal

Long Term Care Medi-Cal pays for care in a skilled nursing facility only. There are very limited waiver programs for care in a Riverside County or San Bernardino assisted living facility, RCFE or at home. There are very strict financial limitations to qualify for Long Term Care Medi-Cal. When the Department of Health Services releases its regulations to conform to the Federal Deficit Reduction Act sometime in 2013 or 2014, qualification for Long Term Care Medi-Cal will become much more difficult. Therefore there is a very limited window of opportunity for those seniors who have a long term care asset preservation plan or life care plan prepared by Riverside elder law attorney Dennis Sandoval prior to the change in the law. Planning for Medi-Cal eligibility should not be undertaken without the assistance of a qualified eldercare attorney, as inappropriate transfers of assets can lead to ineligibility for Long Term Medi-Cal Care for up to five years. Veterans Aid and Attendance

For veterans (or their spouses) who served during a time of war, there are special pension benefits available from the Veterans Administration to help pay for care in the home, assisted living facility, RCFE or nursing home. Eligibility for this benefit, sometimes called Aid and Attendance or Enhanced Pension, requires that the assets and income of the veteran and/or his/her spouse be within the guidelines issued by the Veterans Administration.
